Welcome to Supapen ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website supapen.com and our browser extension (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Supapen is an AI copilot for CodePen.io. It provides AI-powered code generation, allows direct application of code into CodePen editors, and offers context-aware chat to assist with coding tasks.

2. User Accounts

To use certain features of the Service, you may need to create an account. You are responsible for all activities that occur under your account and for keeping your password confidential. We use one-time passwords via email for authentication, facilitated by better-auth. You agree to provide accurate and complete information when creating your account.

3. User Responsibilities and Acceptable Use

You agree not to use the Service for any unlawful purpose or to:

  • Violate any applicable laws or regulations.
  • Upload or share any code that infringes on the intellectual property rights of others.
  • Transmit any viruses, malware, or other malicious code.
  • Attempt to reverse engineer, decompile, or otherwise discover the source code of the Service.
  • Use the Service to develop a competing product.

We reserve the right to suspend or terminate your account if you violate these terms.

4. Intellectual Property

Your Code

You retain ownership of the code you write and provide to the Service ("Input Code"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process your Input Code solely for the purpose of providing and improving the Service.

Generated Code

The Service generates code based on your input ("Generated Code"). While you are free to use the Generated Code, we make no claims about its ownership, correctness, or suitability for any purpose. The use of AI-generated code may be subject to third-party licenses or rights, and you are responsible for ensuring your use of the Generated Code complies with all applicable laws and licensing terms. We do not claim ownership of the Generated Code.

Our Service

All rights, title, and interest in and to the Service itself (excluding Input Code and Generated Code) are and will remain the exclusive property of Supapen and its licensors.

5. Third-Party Services

We use various third-party services to provide our Service, including but not limited to Supabase, OpenRouter, PostHog, Vercel, Resend, and Sentry. Your use of our Service constitutes your acceptance of the terms and policies of these third-party services.

6. Termination

You may terminate your account at any time. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK. WE DISCLAIM ANY WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR SUITABILITY OF THE GENERATED CODE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUPAPEN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT, INCLUDING GENERATED CODE, OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
